How Do Courts Decide Grandparent Visitation?

In Georgia, grandparents can seek visitation when they have been denied access to their grandchild by a child’s parent, as sometimes happen when families break up during a divorce, or when the grandparent has a reasonable belief that their grandchild may be in harms way, such as if a parent has a substance abuse problem or in the face of domestic violence

Therefore, a court may award a grandparent visitation rights when:

  • The grandchild’s health and wellbeing is in question
  • Visitation is in the emotional or financial best interest of the grandchild
  • The grandchild has already been living with their grandparent for at least six months
  • The grandparent has been providing for their grandchild for a year or more
  • Regular visitation between grandparent and grandchild has already been established

In any case, the goal of the court is to ensure the best interests of the child are protected.
